Terms of Service

These Terms of Service ("Terms") govern your use of the Tossit website and application at tossit.services (the "Service"). The Service is operated by Schaffer Energy Consultants, LLC ("Tossit," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and legally able to enter into binding contracts.
Tossit is an AI photo-to-quote tool that allows you to upload photos of items you want removed and receive an instant, AI-generated price estimate for junk removal services. The Service also offers, on an optional basis, the ability to be connected with a local junk removal company if you choose to opt in to being contacted.
You receive three (3) free quotes. After that, additional quotes are available for $10 each, billed via Stripe.
The price estimate generated by the Service is a non-binding estimate produced by artificial intelligence based on the photos and information you provide. The final price for any junk removal job is set solely by the junk removal company after an in-person inspection of the items and site conditions.
Tossit does not guarantee that the AI-generated quote will match the final price. Tossit does not guarantee that any junk removal company will contact you, that any company will honor the estimate, or that any company will provide services at or near the estimated price.
You receive three (3) free quotes per account. After your three free quotes are used, each additional quote costs $10 (USD), payable in advance via Stripe.
All sales are final. Refunds are not available for quotes that have been generated. If you experience a technical failure that prevents a quote from being generated after payment, contact [email protected] for assistance.
You agree to use the Service only for lawful purposes. In particular:
When you upload photos to the Service, you grant Tossit a limited, non-exclusive license to use those photos for the purpose of generating your AI quote and, if you opt in, sharing them with the assigned junk removal partner company.
Tossit owns the Service, its branding, software, design, and all other intellectual property associated with the Service. You retain ownership of your photos subject to the limited license granted above.
If you choose to opt in by selecting "Yes — send my request to a local junk removal company," you consent to be contacted by the assigned junk removal partner company about your junk removal request. The terms of that consent, including the specific authorization regarding phone calls and text messages, are set out in the opt-in checkbox you see before submitting your request. See our Privacy Policy for details on how your contact information is handled.
SMS Verification: Tossit uses SMS to send one-time verification codes to customers who request a quote. By entering your phone number on our website, you consent to receive a verification code via SMS. Message frequency: 1 code per quote request. Message and data rates may apply. Reply STOP to cancel, HELP for help.
The Service and all quotes generated by it are provided "as is" and "as available," without warranties of any kind, whether express or implied. Tossit does not warrant that the Service will be error-free, uninterrupted, or that any quote will be accurate or reliable.
To the fullest extent permitted by law, Tossit disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Tossit's total liability arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid to Tossit for the Service in the twelve (12) months preceding the claim, or $20 USD, whichever is greater.
In no event shall Tossit be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or for loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
You agree to indemnify and hold harmless Tossit, Schaffer Energy Consultants, LLC, and its affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your misuse of the Service, your violation of these Terms, your violation of any law or third-party rights (including uploading photos of property you do not own or control), or your submission of any content that is unlawful, infringing, or prohibited under these Terms.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service ("Dispute") shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, if none apply, the Commercial Arbitration Rules), and judgment on the award may be entered in any court having jurisdiction.
Class-Action Waiver: Any arbitration or court proceeding shall be conducted solely on an individual basis. You and Tossit agree that neither party may bring a claim as a plaintiff or class member in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.
Jury-Trial Waiver: If, for any reason, a Dispute proceeds in court rather than arbitration, both parties knowingly and voluntarily waive any right to a trial by jury.
30-Day Opt-Out: You may opt out of this arbitration agreement by sending a written notice to [email protected] within 30 days of the date you first accepted these Terms. Your opt-out notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration. If you do not opt out within 30 days, you will be bound by this arbitration agreement.
These Terms and any Dispute between you and Tossit shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-laws principles.
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Service.
